Welcome to Banu Musa R&D (“Banu Musa,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website (en.banumusagr.com), our engineering consulting services, digital products (including but not limited to Abaqus plugins, Fortran subroutines, the MatLib material database, and training courses), and our online mentoring and academic support programs (collectively, the “Services”). By accessing our website, purchasing a product, or engaging our consulting services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Who We Are

Banu Musa R&D is an engineering consultancy specializing in Finite Element Analysis (FEA), Computational Fluid Dynamics (CFD), Fitness-for-Service (FFS) assessment, and CAE automation, headquartered at 06-02 Park View Condo, Changkat Perak, off Lorong Perak, 50250 Kuala Lumpur, Selangor, Malaysia. 2. Description of Services

Our Services fall broadly into three categories, each subject to specific conditions below:

  • Consulting & Engineering-as-a-Service (EaaS): Custom FEA/CFD analysis, FFS assessments, failure analysis, design optimization, and remote staff augmentation delivered under a separate scope of work, proposal, or service agreement agreed with the client.
  • Digital Products: Downloadable Abaqus plugins (e.g., MatLib, WCM, Autokeeler), Fortran subroutines (UMAT/VUMAT/DFLUX), and the MatLib material database, sold through our online shop.
  • Training & Mentoring: Pre-recorded courses, masterclasses, and one-on-one Abaqus mentoring sessions delivered online.

3. Eligibility and Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase our Services. When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at info@banumusagr.com of any unauthorized use.

4. Orders, Pricing, and Payment

  • All prices are displayed in the currency shown at checkout and are exclusive of any applicable taxes, duties, or bank charges unless stated otherwise.
  • We reserve the right to correct pricing errors and to modify prices for future purchases at any time without prior notice.
  • Payment must be completed in full before digital products are released, courses are unlocked, or mentoring sessions are scheduled, unless otherwise agreed in writing for consulting engagements.
  • We accept the payment methods listed on our Payment Methods page.

5. Digital Products: License, Delivery, and Restrictions

5.1 License Grant.

Upon full payment, we grant you a limited, non-exclusive, non-transferable license to use the purchased plugin, subroutine, or database strictly for your own internal engineering, research, or academic work. Ownership and all intellectual property rights in the software, source code, documentation, and material data remain with Banu Musa R&D or its licensors at all times.

5.2 Restrictions.

You may not resell, sublicense, redistribute, publish, reverse-engineer, or share purchased digital products or academic-discounted products with third parties, including colleagues outside your verified institution, without our prior written consent.

5.3 Delivery.

Digital products are typically delivered via download link or email within the timeframe stated on the product page. Delivery times for custom subroutine development or configuration may vary and will be communicated separately.

5.4 Nature of Digital Goods.

Because digital products are delivered electronically and can be copied, all sales of digital products, once the download link has been issued or the file has been accessed, are final, except where the product is materially defective or does not match its description. See Section 6 for refund conditions.

6. Refunds and Cancellations

  • Digital products (plugins, subroutines, MatLib entries): Refund requests must be submitted within 7 days of purchase and before the product has been downloaded or activated. Once a download link has been used, the sale is non-refundable, except in cases of a verified technical defect that we cannot resolve.
  • Courses and mentoring sessions: Cancellations made at least 48 hours before a scheduled 1-on-1 session are eligible for rescheduling or a full refund. Pre-recorded course access, once granted, is non-refundable.
  • Consulting engagements: Cancellation, rescheduling, and refund terms are governed by the specific proposal or service agreement signed for that engagement.
  • Approved refunds are issued to the original payment method within a reasonable timeframe and may be subject to transaction fees outside our control.

7. Academic Discount Program

The 40% academic discount is available exclusively to verified MSc/PhD students and academic researchers using a valid institutional email or documentation. We reserve the right to request proof of enrollment, to deny or revoke the discount if eligibility cannot be verified, and to restrict academic-discounted products to non-commercial, thesis- or research-related use only. Misuse of the academic discount for commercial purposes may result in account suspension and additional billing at full price.

8. Consulting Services and Confidentiality

For consulting and EaaS engagements, the specific deliverables, timelines, fees, and responsibilities are defined in a separate proposal, quotation, or service agreement, which forms part of these Terms for that engagement. We treat client-provided technical data, CAD models, and project information as confidential and will not disclose them to third parties without consent, except as required to deliver the agreed Services or by law. Clients agree to keep any proprietary BanuMusa methodologies, scripts, or subroutines shared during an engagement confidential.

9. Intellectual Property of the Website

All content on this website — including text, graphics, logos, blog articles, tutorials, and images — is the property of BanuMusa R&D or its content providers and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or distribute this content without our prior written permission.

10. Disclaimer of Warranties

Our simulation results, engineering recommendations, plugins, subroutines, and material data are provided as engineering tools and professional opinions based on the information and inputs available at the time of analysis. They are intended to support, not replace, your own engineering judgment, independent verification, and compliance review. We make no warranty that any analysis, product, or recommendation will be free of errors or fit for a particular safety-critical application. Final engineering decisions, physical validation, and regulatory compliance remain the sole responsibility of the client. Our Services and products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Banu Musa R&D shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or business interruption, arising from your use of our Services, products, or website. Our total liability for any claim arising from a purchase or engagement shall not exceed the amount you paid for the specific product or service giving rise to the claim.

12. Third-Party Links and Tools

Our website and Services may reference or link to third-party tools, platforms (such as Abaqus, LS-DYNA, or Particleworks), or payment processors. We do not control and are not responsible for the content, policies, or performance of these third parties.

13. Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless otherwise agreed in a specific service agreement.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or for legal reasons. The “Last Updated” date at the top of this page indicates when the Terms were last revised. Continued use of our website or Services after changes take effect constitutes your acceptance of the revised Terms.
